Delaware Bill Threatens Sussex County’s Zoning Authority—Public Hearing This Monday!


Carpool to Legislative Hall on Monday - Meet at Hockers Grocery Store on Fred Hudson

We need patriots to gather at Legislative Hall this Monday to send a message to the New Communist County Delusional Democrat Destroyers that we will not tolerate their authoritarian government overreach and disregard for the decisions made by our duly elected Sussex County Council. If the Democrat Destroyers pass this law, local governance will be at risk throughout our state—no town, municipality, city, or even county will be safe from the mandates of New Castle County progressive socialists. It is crucial to take a stand now, and our Republican Caucus is calling on all patriots to demonstrate our will and solidarity in person this Monday, June 2, at 1 PM.


Plan to meet at Hockers Grocery Store on Fred Hudson Road at 10:30 am this Monday. Anyone meeting should aim to leave by 11:00 am to arrive at Legislative Hall by noon. Alternatively, you can organize your own carpool. We need YOU!

On Monday, June 2 at 1:00 p.m., the Senate Environment, Energy & Transportation Committee will consider Senate Bill 159, a bill our caucus believes is one of the most egregious breaches of local control we’ve seen.


Prime sponsored by a senator from New Castle County, SB 159 is a direct response to a decision made by the Sussex County Council last year when they voted to deny a permit for an energy substation after hearing from residents and weighing local concerns.


Instead of respecting that local process, this bill would override Sussex County's decision and prevent any county in our state from deciding similar in the future.


If you believe, like we do, that these decisions should remain with the people who live in and understand their communities, register to offer public comment during Monday's committee meeting and let your voice be heard.

One thing our caucus has always believed: local leaders know what’s best for their communities.


That’s why we’re deeply concerned about legislation moving through the General Assembly that chips away at local control. The most troubling example this year is Senate Bill 159, which is a direct response to a decision made by the Sussex County Council to deny a conditional use permit for a US Wind substation.


Now, Democrat lawmakers, predominantly from outside Sussex County, are pushing a statewide policy change to override that local decision, setting a dangerous precedent that will affect every corner of our state.

"Local control in Delaware is under attack. The General Assembly is aggressively advancing bills that sideline our counties and municipalities in favor of centralized state power.


This session, several bills have come before the legislature that do little more than override the judgment of our local governments. The most egregious example is Senate Bill 159, a direct response to a decision made by Sussex County Council to deny a conditional use permit for a US Wind substation. But, because some in Dover didn’t like the outcome, they crafted legislation to change the rules and strip Sussex County Council, and the other two counties in our state, of their authority on these matters.


What’s especially troubling is that this bill is being led by a senator from New Castle County, not someone who represents the residents of Sussex. The message is loud and clear: The upstate legislators think they know better than the local officials who actually live and work in our communities.


This isn’t just about one substation. SB 159 would create a statewide mandate allowing the Public Service Commission to override local governments on the siting of critical infrastructure, effectively turning every community into a doormat for state-level decisions made without regard for local impact or resident concerns.


It’s part of a pattern we’ve seen during the first half of the 153rd General Assembly.

Senate Bill 75 proposes to override county government decisions regarding zoning, specifically for marijuana dispensaries.


Senate Bill 87 would override municipal ordinances and homeowners associations’ rules regarding accessory dwelling units.


This trend is alarming. Our caucus laid out these concerns a couple weeks ago in a blog post, and the evidence continues to mount. Taken together, these bills represent a slow but dangerous shift toward centralized decision making in a state that has long valued the strength and insight of local government.


I have always believed that the people closest to a problem are usually the ones best equipped to solve it. That’s why we elect mayors, council members and commissioners. They understand the fabric of their communities and are accountable to the people they serve, not to a bureaucracy in Dover.


If you care about your community’s ability to shape its own future, now is the time to speak up. We must defend the principle that local governments matter, that local voices deserve to be heard and that state government should support, not undermine, the leaders closest to the people.


I urge my colleagues to oppose SB 159 and any other bill that weakens local control.

Good government doesn’t come from the top down. It grows from the ground up."

The Indian River School District will hold another funding increase Referendum on Thursday, June 5th, 7am to 8pm. This Referendum is identical to the last Referendum, an increase in property taxes of 37%. We will again need Poll Watchers on this day to assist voters to understand who can and who cannot vote, and observe the process.
