Delaware likely to issue the final Offshore Wind permit January 31st.Â

The Battle Over Offshore Wind War Rages OnÂ
Sussex County is facing an attack on our sovereignty by the State of Delaware, over local zoning control and the US Wind Maryland Offshore Wind Project, which has been issued permits by DNREC to land power cables at 3R’s Beach at Delaware Seashore State Park in Bethany Beach, run through the marsh and to jet plow Old Basin Cove and the Indian River to lay four cables the length of the River to the former NRG Indian River Power Plant.Â
A series of legislation passed by the Delaware legislature over the past couple of years, SB265 signed by former Governor John Carney, as well as SB159, and SB199 signed into law this year by Governor Meyer, would allow the state of Delaware to come in on January 31, 2026, override Sussex County Council’s vote to block the permit, and issue the final permit needed for the Delaware construction of the project to begin. This series of legislation is a direct attack on the Sussex County Council and includes illegal spot zoning for the foreign owned company, Renexia sPa.

Despite Ongoing Lawsuits Delaware Likely to Issue Final Offshore Permit January 2026
The Maryland District court case (1:24-cv-03111-SAG) still drags on and has no ruling on injunctions to stop the Trump administration from taking action against the project nor with the Marzulla Law Firm's motion on behalf of Caesar Rodney Institute, Ocean City, Fenwick Island, and over thirty local plaintiffs including businesses, organizations, and local citizens. Without a favorable ruling in this case to stop the offshore wind project, and one to challenge to SB159, the state of Delaware is likely to issue the final permit on or around January 31st.Â
Sussex County Council Must Be Urged to Act this Month of December
Sussex County residents should call and write their County Council Representatives and advise them that the constituents want the Sussex County Council to challenge SB159/199 and to bring on at no cost, Attorney Jane Brady to help fight the battle. Jane Brady has been instrumental in holding DNREC accountable in the appeals cases for providing a full record of information that was received and considered in their issuance of construction and subaqueous permits for the US Wind project. Those appeal cases also drag on.Â
The necessary appeal must be filed by Sussex County before SB199 takes effect this coming January 31st. Now is the time to contact the Council as preliminary filings need to be filed in Chancery court in December. Should this bill not be challenged in court, offshore wind opponents will be leaving a flank open to attack from offshore wind developers.Â
While it is likely that most locals are against offshore wind and should want the challenge just based on that, the legislation in bills SB159 and SB199 set a dangerous precedent and should Sussex County not appeal, this is likely to be just the beginning of state government overreach. Please call your Sussex County Council representatives and tell them we need to bring on Attorney Jane Brady to appeal the constitutionality SB199. Sussex County Council's action in this matter may be our only hope to stop offshore wind from coming in January 2026.
