Sussex County Council Can Still Counter SB 159 With A Lawsuit
One possible solution to stop foreign owned US Wind forever, is for Delaware to adhere to the lawful decision made by the Sussex County Council, to prohibit the offshore cables coming onto to 3Rs Beach, overturned by SB159. In order to do this, Sussex County Council must file a lawsuit against this overreach action taken by the Delaware democrat controlled legislature. New wind and solar projects must start construction by July of 2026 in order to qualify for federal tax subsidies that are essential to obtain project financing. The Treasury Department has issued tighter rules to define when construction starts. They may not be tight enough to stop the US Wind project, but the timeline is really tight.
In brief, US Wind would need to start building the concrete pads with anchor bolts for turbine towers, which would also require placing tons of stones before concrete is poured. They must also have signed binding contracts to purchase the towers, blades, and supporting materials with construction of those parts begun by the manufacturers. Construction must be continuous. The project must be complete in four calendar years. See below for exact wording.
The first question that must be settled is does US Wind have all its approvals so it can even start the process. With approvals in question it would seem financing would not be available so construction contracts could not be signed.
The US Environmental Protection Agency has stated Maryland approved and Air Quality Permit that needs to be redone. The question over whether the permit needs to be redone is now being challenged in court.
US wind still has no conditional use permit from Sussex County Council to build an electric substation to receive the power on shore. The Delaware legislature overruled the county’s permit denial subject to a Delaware Superior Court decision in a case where US Wind sued the county to allow the permit. That may not be decided until January 31, 2026.
The US District Court in Baltimore is to decide several cases on September 5, but the Federal permitting agency is reviewing the claims federal permits were flawed and need to be revoked, and that would end the lawsuit and stop the project.
The next issue becomes whether all these questions are answered soon enough to sign construction contracts, and actually begin construction by the July, 2026 deadline.

I am writing to urge you to take legal action against SB159. The Sussex County Council made a lawful decision to deny US Wind’s cables from landing at 3Rs Beach, and that decision was overturned by the Democrat-controlled legislature.
This is government overreach that strips away Sussex County’s authority over land use and sets a dangerous precedent for the future. Please defend our county, our rights, and the integrity of your decision by filing a lawsuit to challenge SB159.
